Introduction

Welcome to Greenpath Web Solutions. By engaging our services, you agree to be bound by the following terms and conditions. Please read them carefully before proceeding. These Terms of Services (the “Terms”, or “TOS”) in addition to our Policies are a contract between Greenpath Web Solutions. (“Greenpath”, “We”, “Our”, or “Us”) and You (“You” or “Your”) and govern Your use of the Services We offer, including our digital marketing program Foundation Repair Lead Engine ("Program") and our website foundationleadengine.com, unless We have a custom agreement in place that references different terms. As such, please read these Terms and our Policies (collectively, “Agreement”) carefully.By accessing or using our services, you affirm that you are at least 18 years old and legally capable of entering into this agreement. You acknowledge and agree to the collection and use of your information as outlined in our Privacy Policy.


Services Rendered

All services provided by Greenpath Web Solutions will commence only upon receipt of full payment. The initiation of any project, campaign, or other marketing services will begin at this time. 

Greenpath Web Solutions provides digital marketing services designed to improve your online presence. Our core services include:

  • Local SEO: Optimizing your business for local search visibility, including Google Business Profile updates and local keyword targeting.
  • Website Development: Building and optimizing user-friendly websites to support your marketing efforts.
  • Content Creation: Crafting SEO-optimized content for blogs, service pages, and other digital assets.
  • Organic SEO: Improving your site’s rankings on search engines through on-page and off-page optimization.


Customization of Services:
Each service package is tailored to the client’s specific needs as outlined in the initial agreed upon scope of work. Any modifications or additions beyond the agreed-upon scope may incur additional fees.


Exclusions:

  • We do not guarantee specific results, such as rankings or sales, due to factors outside our control, including search engine algorithm updates, market conditions, or user behavior.
  • We do not manage billing information directly. All payments are processed securely through Stripe, and as such, we do not have access to your billing information. See our Privacy Policy for more information.


Client Responsibilities:
To ensure the success of our efforts, clients are required to:

  • Provide accurate and up-to-date business information.
  • Grant necessary access to tools and platforms (e.g., Google Analytics, Google Business Profile).
  • Respond promptly to requests for approvals or additional information.


A2P Messaging & Consent

We send SMS messages to users for marketing, transactional updates, appointment reminders, and customer support. Our messaging practices comply with A2P 10DLC, TCPA, CAN-SPAM, GDPR, and CCPA regulations.

Fees & Rate Disclosures

Our services may include SMS communications, and message and data rates may apply based on your carrier plan. We are not responsible for any fees incurred due to SMS messages sent or received as part of our services.

Payment Terms

All payments for services are due upfront. Greenpath Web Solutions operates on a monthly billing cycle, and payments are required in advance for each month’s services. Once payment is received, services will be rendered according to the agreed-upon scope of work.

Opt-in Requirement: Users must provide explicit consent before receiving SMS messages from us. Consent may be obtained via:

- Web forms

- Keyword signups

- Purchase agreements

Opt-out Options: Users can opt out at any time by replying STOP to any message or contacting us at service@getgreenpath.com.

Message Frequency: We send 1-2 messages per week for promotions, service updates, and reminders.

Fee Disclosure: Standard message and data rates may apply as per your mobile carrier’s plan.


Credit Card Authorization

By providing your credit card information to Greenpath Web Solutions, you are authorizing us to charge your card for the agreed-upon services on a recurring monthly basis. This authorization will remain in effect until you cancel your services according to the cancellation policy outlined in Section 6. Providing your credit card information is considered a legal signature and serves as your consent to these recurring charges. 


No Refund Policy

Due to the nature of our services, all monthly payments are non-refundable. This applies to all services provided by Greenpath Web Solutions, including but not limited to digital marketing, content creation, SEO, and website development. By making a payment, you acknowledge and agree that no refunds will be issued. 


Cancellation Policy

Clients may cancel their services up to one (1) business day prior to the renewal date of their monthly billing cycle. To cancel, you must contact us in writing at service@getgreenpath.com. If cancellation is not made within this timeframe, the service will automatically renew for the following month, and you will be charged accordingly. 


Data Privacy & Third-Party Sharing

We respect your privacy and do not sell your data. However, we may share information with trusted third-party service providers for essential business operations, including:

- Payment Processors (to handle transactions securely)

- CRM Platforms (GoHighLevel) (for customer relationship management)

- Marketing Platforms (for Google Business Profile (GBP) management and advertising services)

Disclaimer of Results

While Greenpath Web Solutions aims to deliver high-quality digital marketing services, we cannot guarantee specific results due to factors outside our control, such as search engine algorithms, market conditions, and user engagement. By using our services, you acknowledge and agree that any estimated results, projections, or metrics provided are indicative only and not guaranteed. In addition, some results depend on your participation, such as with providing relevant information and collecting reviews according to the reccomended strategy. In many cases your lack of participation in these activities may have significnat detrimental effects on our ability to obtain desired results, and Greenpath Web Solutions will not be held liable for such. 


Limitation of Liability

Greenpath Web Solutions is not liable for any direct, indirect, incidental, or consequential damages resulting from the use of our services, including but not limited to business interruption, lost data, or lost profits. Clients are advised to review and understand our service offerings and limitations before making a purchase. 


Dispute Resolution & Governing Law

Any disputes arising from these Terms will be governed by the laws of the State of Georgia, USA. Disputes must first be resolved through informal negotiation. If unresolved, disputes shall be settled through binding arbitration in Georgia, in accordance with the rules of the American Arbitration Association (AAA).


Changes to Terms

Greenpath Web Solutions reserves the right to update or modify these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website and notifying clients via email. It is your responsibility to review these terms regularly to ensure you are aware of any updates.
